New Delhi: While hearing the Kolkata rape-murder case, the Supreme Court said that if the doctors have not gone to work, they will be considered absent. The law will work according to itself. The AIIMS Doctors Association said on this that we are being harassed. We were on protest. The CJI said that if you are on duty then it is fine, if not then the law will do its work. You first come back to work. CJI Chandrachud said that the doctors should return to work. We have formed an expert committee. The doctors should join duty, people are waiting for them.

If doctors return to duty, no action should be taken against them

The Chief Justice said that it is important for the doctors to return to work. The heads of hospitals are also doctors and they are with them on their problems and issues. But if the doctors do not return to work, the structure of government health care will collapse. Doctors of PGI Chandigarh also expressed their problems. The CJI said that you people should return to work. We will give a general order. While giving the order, the court said that if the doctors return to duty, no action should be taken against them. The SG said that the doctors should be satisfied with the assurance of this court.

Court asked doctors to return to work

The Supreme Court again appealed to the protesting doctors to return to work. The CJI said - Once the doctors return to work, no action will be taken against them. Our general order will be applicable only then. The CJI said that this broad-based national task force is there so that all stakeholders including resident doctors will be consulted. Therefore, their views will be heard.

CJI also said these things

CJI said that the task force will listen to the representatives of doctors, nurses and paramedical staff. Their opinion will be taken. The opinion of all the parties will be taken. This is very important. Delhi Medical Association said that we had filed a PIL on this issue two years ago. CJI said that the associations have filed applications for giving opinion. What I am saying is that the task force will prepare a report on this. It will look into the presentations. 

CJI said- I have also slept on the floor in the hospital

The CJI said that I have also slept on the floor in a public hospital when a relative was ill. We know that doctors are working 36 hours. I myself have slept on the floor in a government hospital when a member of my family was ill. 

This argument was given by the doctors associations

Senior advocate Vijay Hansaria, appearing for the Delhi Medical Association, said that we are a 110-year-old association. The CJI asked if we could give some suggestions. If you can give a slip of names and the bodies representing all the different bodies that are intervening, we will put it in order and we will say that the task force should take steps to engage with everyone.

Resident doctors of Nagpur AIIMS filed an application saying that due to the protest, they are being attacked. They are not even being allowed to take exams. CJI said that if the doctor is on duty, he will not be considered absent. But if he is not on duty, the law will be followed. The court said that no action will be taken against the doctor. If there is any problem after that, the court can come. 

The court said we have also received many emails

The court said that doctors should return to their work. If they do not return to work, how will the public administrative structure run. Doctors will join ANF. Because resident doctors are assured that their matter will be heard by the National Task Force. CJI said that we have received many emails in which it is said that there is a lot of pressure on them. 48 or 36 hours duty is not good.
