National: The government is considering stringent penalties for misuse of national symbols. For this, the central government is considering important amendments in the Names and Emblems (Prevention of Improper Use) Act, 1950, so that the law can be strengthened.
Increase in fines and imprisonment
Sources said the proposed changes include an increase in penalty and imprisonment. Under the current law, violators have to pay a fine of just Rs 500 for improper use of symbols and names. The Act prohibits the use of national emblems in the title, trademark, design or for any patent or for any trade, business or profession without the permission of the central government.
The Ministry of Consumer Affairs is pushing the amendment process. According to sources, the ministry has proposed to increase the fine to Rs 1 lakh for first-time offenders.
A fine of up to Rs 5 lakh and imprisonment of six months
Repeat offenders can face a fine of up to Rs 5 lakh and a jail term of six months. Some ministries have advocated for lesser penalties and abolition of jail term. The final decision in this regard has to be taken by the Union Cabinet.
